1. Who We Are

PerksLoaded is owned and operated by Loyalty Rewards Limited (NZBN/Company Number 9271239), a company registered in New Zealand, based out of Te Atatu South, Auckland, New Zealand ("we," "us," "our").

By creating an account or using the PerksLoaded app ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use the Service.

2. About the Service

PerksLoaded is a digital loyalty rewards platform that allows you to earn points and redeem vouchers at participating local retail stores ("Merchants"). Each Merchant operates its own independent rewards program within the app — points, vouchers, and tier status earned at one Merchant are separate from and do not transfer to another Merchant, unless the app explicitly indicates otherwise (for example, a shared login that lets you register at a new Merchant without re-verifying your phone number).

3. Eligibility

You must be at least 18 years old and capable of forming a legally binding contract to create an account. By registering, you confirm that you meet these requirements.

4. Account Registration

To use the Service, you must verify your mobile phone number via a one-time SMS code. You agree to:

• Provide accurate, current information (including your name, if provided)
• Keep your account details up to date
• Not create multiple accounts for the same Merchant using different phone numbers with intent to exploit or duplicate rewards
• Not share your account or member barcode with others for the purpose of fraudulently accumulating points

We reserve the right to suspend or terminate accounts we reasonably believe are being used fraudulently or in violation of these Terms.

5. Points, Vouchers, and Rewards

• Points and vouchers earned through PerksLoaded have no cash value and cannot be exchanged, redeemed, or refunded for money under any circumstances.
• Points and vouchers are non-transferable between customer accounts.
• Points, vouchers, and tier status are specific to the Merchant that issued them and can only be redeemed at that Merchant, unless otherwise stated.
• Points may expire, and vouchers have a stated expiry date, in accordance with each Merchant's individual rewards rules, which may vary and may change from time to time.
• We and our participating Merchants reserve the right to modify, suspend, or discontinue any rewards program, points structure, or voucher terms at any time, with or without notice, though we will endeavour to give reasonable notice of material changes where practical.
• We reserve the right to void points or vouchers obtained through fraud, error, or violation of these Terms.

6. Deleting Your Account

You may delete your account at any time from within the app (Profile → Delete my account). Deleting your account permanently removes your name, phone number, and points balance from that Merchant, cancels any active vouchers, and logs you out on all devices. This action cannot be undone. Deleting your account at one Merchant does not affect any separate account you may hold with another Merchant.

7. Merchant Responsibility

Loyalty Rewards Limited provides the PerksLoaded technology platform only. We are not responsible for the quality, safety, legality, pricing, or availability of any goods or services sold by participating Merchants. Any dispute regarding a purchase, product, or in-store experience is between you and the relevant Merchant directly.

8. Limitation of Liability

To the maximum extent permitted by New Zealand law, Loyalty Rewards Limited will not be liable for any indirect, incidental, or consequential loss arising from your use of the Service, including loss of points, vouchers, or data, except where such liability cannot be excluded by law (including under the Consumer Guarantees Act 1993, where applicable).

9. Privacy

Our collection and use of your personal information is governed by our Privacy Policy, which forms part of these Terms.

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example, via an in-app notice). Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Termination

We may suspend or terminate your access to the Service at our discretion, including for breach of these Terms, without liability to you, to the extent permitted by law.

12. Governing Law

These Terms are governed by the laws of New Zealand, and any disputes will be subject to the exclusive jurisdiction of the courts of New Zealand.

Privacy Policy

This Privacy Policy explains what information PerksLoaded collects from customers who use the PerksLoaded mobile app, and how that information is used. PerksLoaded is a loyalty rewards program made available to customers of individual participating retail stores ("merchants"). Each merchant operates its own separate rewards program and customer data through PerksLoaded — your information is only ever visible to the specific merchant(s) you choose to shop with and enrol with.

Information we collect

• Phone number — used to identify your account and to send you a one-time verification code when you sign in.
• Name — optional, provided by you so staff and the app can address you by name.
• Purchase and transaction history — the amount of qualifying purchases, and the points, vouchers, and rewards associated with them.
• Referral information — if you use or share a referral code, we record the connection between the referring and referred accounts so we can credit any referral bonus correctly.
• Push notification token — if you allow notifications, a device-specific token is stored so we can send you updates about your points, vouchers, and promotions. You can decline this at any time without affecting your ability to use the app.

How we use this information

• To operate your loyalty account — tracking points, vouchers, tier status, and rewards for the merchant(s) you're enrolled with.
• To verify your identity when you sign in, using a one-time code sent by SMS via our SMS delivery provider.
• To send you optional notifications about your account, such as points earned, vouchers ready to redeem, or promotions from a merchant you're enrolled with.
• To prevent fraud and abuse of the rewards program, such as detecting unusual sign-in attempts.

Who we share information with

We do not sell your personal information, and we do not share it with third parties for their own marketing purposes. Information is shared only as needed to operate the service:

• With the specific merchant(s) you are enrolled with, since your loyalty account belongs to their program.
• With our SMS delivery provider, solely to deliver one-time verification codes to your phone number.
• With our cloud hosting and database providers, who store this information securely on our behalf and do not use it for any other purpose.

Data retention

We retain your account information for as long as your account remains active with a given merchant. If you'd like your data deleted, contact us using the details below and we will remove it, except where we're required to retain certain records for legal or accounting purposes.

Your rights

You can ask us to access, correct, or delete your personal information at any time by contacting us below. If you're located in New Zealand, you also have rights under the Privacy Act 2020, including the right to complain to the Office of the Privacy Commissioner if you believe your information has been mishandled.

Children's privacy

PerksLoaded is not directed at children, and we do not knowingly collect information from anyone under the age of 16.

Changes to this policy

We may update this Privacy Policy from time to time. If we make material changes, we'll update the date at the top of this page.

Delete Your Account

PerksLoaded — how to request account deletion

You can request deletion of your PerksLoaded account and all associated data at any time. Here's how:

Steps to request deletion

• Step 1: Email perksloaded07@gmail.com from any email address.
• Step 2: Include your full name and the phone number registered on your PerksLoaded account, so we can locate it.
• Step 3: We'll confirm your identity and process the deletion within 5 business days.

What gets deleted

Your name, phone number, points balance, transaction history, vouchers, referral connections, and any receipt images you've uploaded.

What we retain, and for how long

Transaction records may be retained for up to 12 months after deletion where required for fraud prevention, accounting, or legal compliance, after which they are permanently deleted as well.
